Frequently Asked Questions
- Once my Dealership is established, does it essentially become a Branch Office of Hunter Wise Commodities?
- No. Each Dealership conducts its business affairs as an independent entity. For example, the Dealer formulates its own marketing initiatives, establishes its sales practices, determines its sales commission and fee structure, develops its Human Resources and Compliance guidelines, and independently sources its market research and trade recommendations.
- Does an independent government agency audit the purchase and storage of all metal investments?
- Yes. Hunter Wise Commodities and Dealers in the precious metals business are subject to audit by state and federal regulators. The sale of physical commodities does not require a license; however, the Commodities Futures Trading Commission (CFTC) will occasionally audit businesses engaged in the sale of physical commodities to ensure that such sales are not off-set with futures contracts or options which do require licensing.
- What is the Model State Commodity Code?
- This is an enforcement statute that states can enact against fraudulent business activity involving off-exchange commodity transactions that would otherwise be unenforceable under current Federal regulations. The Code was formulated as a joint effort between various states' securities regulators, the Commodity Futures Trading Commission (CFTC), and the National Futures Association (NFA).
- Is Hunter Wise Commodities LLC supportive of the Model State Commodity Code?
- Yes. Hunter Wise Commodities is enthusiastically supportive of any practical initiative that helps to rid our industry of fraudulent business practices while preserving the ability of ethical companies to engage in legitimate physical commodity transactions.
- Since my Dealership will be lending money to retail customers, will it be necessary to obtain a Lender License to do so?
- Hunter Wise Commodities strongly recommends that each Dealer obtain a definitive answer to this question from its own legal counsel. Nevertheless, Hunter Wise has obtained useful information on this subject from a variety of states in an effort to expedite your discovery process.
- Does Hunter Wise LLC offer Dealers the ability to trade the market in either direction?
- Yes. Hunter Wise Commodities provides Dealers the opportunity to profit in declining markets by taking advantage of our "Commodity Loan" transaction.
- Does Hunter Wise LLC maintain a retail sales division in addition to its wholesale division?
- No. Hunter Wise Commodities provides our products and services exclusively to an international network of Independent Dealers. We do not compete with our Dealers for retail customers, and our business model is not designed to do so.
